Split decision in Kearney hearing
Earnest Kearney lost 130 chickens and pigeons, but will have his other 256 animals back at Kearney's Store in Sunnyvale by Tuesday evening.
Dallas County Justice of the Peace Gerry Cooper ruled Friday evening that the rabbits, horses, sheep and other livestock taken Oct. 6 will be returned to Kearney from the SPCA of Texas.
Kearney said he considered the ruling a victory, but still faces misdemeanor animal cruelty charges and was asked to pay $12,000 to the investigation, care and housing of the chickens and pigeons seized by and forfeited to the SPCA.
