Animal Services, individuals sued over dog seizure
By Dan Klepal • dklepal@courier-journal.com • October 29, 2009 • A Louisville couple filed a federal lawsuit Thursday against Louisville Metro Government, the director and assistant director of Metro Animal Services, and animal control officer for allegedly entering their home and seizing two adult pit bulls and a litter of puppies without a warrant.
Attorney Jon Fleischaker filed the suit on behalf of James and Angela O’Neill. It names Dr. Gilles Meloche, the Animal Services director; Wayne Zelinsky, and assistant director; Terry Pendleton, an animal control officer. It also lists other unnamed parties as defendants.
Fleischaker said he knows of “several” other instances where homes were entered and animals seized without warrants and said more lawsuits could be forthcoming.
The couple is suing for an unspecified amount to cover compensation of their losses and punitive damages. They also want the city to pay for costs and attorney’s fees.
